Information document on the processing of personal data

In compliance with the Federal Data Protection Act (DPA). We provide you with the necessary information regarding the processing of personal data provided in the course of browsing this website. This information does not apply to other websites (e.g. other websites that can be consulted via links on this page). We are in no way responsible for the websites of third parties.

What personal data is processed? What does processing mean? Who is the data subject?

Personal data: any information concerning a data subject that identifies him or her or makes him or her identifiable. Through its website, BEiT SA collects various types of personal data, including but not limited to: name, surname, e-mail address, telephone number, IP address.

Processing is any operation or set of operations, carried out with or without the aid of automated processes, applied to personal data or set of personal data, such as collection, recording, organisation, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, restriction, deletion or destruction.

Data subject is an identified or identifiable natural person. By way of example (non-exhaustive), the data subject is the user who navigates on the platform and sends, through it, a request for information.

Who is the Data Controller? How to contact him/her?

The data controller within the meaning of the DPA is BEiT SA, with registered office in Lugano and address at Vicolo Concordia 1, 6932 Lugano-Breganzona, represented by the persons entitled to sign in accordance with the entries in the Cantonal Commercial Register (link).

Why does BEiT SA process your data? What basis allows the owner to process them?

PURPOSE OF PROCESSING

a) navigation on this website

Activities strictly necessary for the operation of the site and the provision of the platform navigation service.
The computer systems responsible for the operation of this site acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes the IP addresses or domain names of the computers and terminals used by users, the URI/URL (Uniform Resource Identifier/Locator) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and IT environment.

b) to contact you as per your request sent by filling in our CONTACT FORM in order to provide feedback on any requests for information that you may wish to submit to our consultants.

The data collected will be first name, last name, e-mail, The request sent will be forwarded to our operator who will put you in contact with our consultants.

PURPOSES OF THE PROCESSING

c) Direct marketing by the Data Controller, newsletters, market research or other sample research and direct sales to receive – by automated means such as e-mail or SMS or other means, as well as by telephone calls through an operator and by paper mail – informative material, to survey the degree of satisfaction, promotional, commercial and advertising material or material relating to events, initiatives, courses promoted by the Data Controller.
Justification: consent of the data subject.
Storage period: until consent is revoked.


To whom will the personal data collected be communicated?

The data of a personal nature supplied will be communicated to recipients, who will process the data in their capacity as persons acting under the authority of the Data Controller and Data Processor, for the purposes listed above.

Specifically, the data will be communicated to

a) subjects that provide services for the management of the information system used by BEiT SA and telecommunications networks (including e-mail);
b) subjects that support the data controller in the management of web platforms;
c) firms or companies in the context of assistance and consultancy relationships;
d) authorities responsible for fulfilling legal obligations and/or provisions of public bodies, upon request;
e) companies providing services for sending newsletters.

The list of Data Processors is constantly updated and available at the Data Controller’s head office.

Communication of data abroad

BEiT AG only uses certified and secure service providers that (i) are based in Switzerland or (exceptionally) in the European Union and (ii) process personal data in Switzerland or (exceptionally) in the European Union. Disclosures of personal data to states that do not provide adequate data protection under Swiss and European law are therefore excluded, except for disclosures that are based on the prior express consent of the data subject or on his/her explicit instructions, or that are carried out on the basis of a legal obligation.

Is the provision of data compulsory? Or is it necessary? Or is it optional?

The provision of navigation data (purpose a)) is compulsory as it is automatically carried out to allow you to navigate on the site. The provision of first name, last name, e-mail address, telephone number is necessary to send a contact request by filling in the forms located in the “CONTACTS” section (purpose b)). Failure to provide name, surname, e-mail address and telephone number will make it impossible to send the request. The data provided for purpose b) will be used for purpose c), direct marketing, exclusively in the presence of your consent.

What are your rights? How can you exercise them?

Under the conditions set out in the DPA, the Data Controller recognises in particular the following rights (non-exhaustive list)

to obtain the rectification of inaccurate or outdated personal data:
to be informed in writing and free of charge if personal data concerning you are being processed;
withdraw consent to the processing of data that you have previously given
prevent the disclosure to third parties of personal data worthy of special protection;
express your opinion on an automated individual decision or request that it be reviewed by a natural person;
obtain delivery of your personal data or demand their transmission to a third party;
request that data processing be stopped, that disclosure to third parties be prevented, or that personal data be rectified or destroyed;
the right to demand that a certain processing of personal data be prohibited, that a certain disclosure of personal data to third parties be prohibited, or that personal data be deleted or destroyed;
if neither the accuracy nor the inaccuracy of the personal data can be proved, to request that an indication be added to the data to the effect that it is disputed;
request that the rectification, destruction, blocking, in particular the communication to third parties, as well as the mention of the contested character or the judgment be communicated to third parties or published;
have the unlawfulness of the processing of personal data established.

Without prejudice to any other administrative or jurisdictional recourse, if you believe that the processing of your data is in breach of the provisions of the DPA, you have the right to lodge a complaint with the competent Data Protection Supervisory Authority (Switzerland: SDPC).

You may exercise your rights as set out in the DPA by contacting the Data Controller via privacy@www.beitsa.ch or the Data Protection Advisor via dpo@www.beitsa.ch. Without prejudice to any other administrative or judicial remedy, if you believe that the processing of data relating to you is in breach of the DPA, you have the right to lodge a complaint with the competent Data Protection Supervisory Authority (Switzerland: SDPC). To stop receiving automated direct marketing communications (e-mails, text messages), simply write an e-mail to privacy@www.beitsa.ch at any time with the subject line “unsubscribe from automated marketing” or use our automatic unsubscription systems for e-mails only (newsletters).
If you no longer wish to receive traditional direct marketing communications (telephone calls with operator), simply write an e-mail to privacy@www.beitsa.ch with the subject line “unsubscribe from traditional marketing” at any time.

Further information: modification │ entry into force

The owner reserves the right to change, update, add or remove parts of this privacy policy at its own discretion and at any time. Before using the Site or related resources (e-mail, telephone, social accounts, etc.), it is therefore incumbent on the user to check the content of the current policy. In order to facilitate this verification, the notice will contain the date of its update.
